My problem is that my real estate has also gone to the birds.
Do I need to talk to the town planning department to check on permits for expanding my home?
And are we now considered a multi-unit dwelling?
The issue is that the birds have turned my single family residence into a condo complex, AND without my permission (are they trespassing? Are they considered squatters? Can I take over their homes by eminent domain and will I get sued if I do so?).
- Will this have an impact on my deed?
- Do we now have to charge a condo fee?
- And create an HOA? What does this do to my insurance?
- Do I need a Master Insurance Plan? What should I charge them for HOA fees?
- Do I need a security deposit?
The finches have claimed the eaves on my front porch as their own, and there are not 1, not 2 but 4 nests now. We had 1 or 2 in the past but clearly some avian developer decided the property prices in La Costa, Carlsbad were the lowest they've seen in years and decided to build. Not sure they got approval from the City of Carlsbad Building Department but clearly they don't care. Clearly the word is out that THIS is a desirable neighborhood.
What's really silly is that these dumb birds can't truly enjoy the properties they have built. As soon as someone walks in or out the door they are off. I suppose next I will be served with a subpoena summoning me to court to answer to a lawsuit for interfering with the "quiet enjoyment of their dwelling," a violation that can get someone in hot water here in California.
That's OK. The cats are on my payroll and only need a word from me to take matters into their own paws. But since I'm basically a pacifist...
No doubt we will soon be blessed with more residents that will boost the density of the complex well beyond what any mortgage company considers acceptable. If they move can I resell for a profit? What if they leave their condo a mess...do I have to return the security deposit? I didn't ask to be a landlord. Why me?
